TERMS AND CONDITIONS

In these terms and conditions, “we” “us” “b.o.d” and “our” refers to Beauty on Demand This page tells you information about us and the legal terms and conditions (Terms) on which we sell any of the products or services listed on our website (our site) to you.

These Terms will apply to any contract between us for the sale of products or services to you (Contract). Please read these Terms carefully and make sure that you understand them, before ordering any products or services from our site.

We reserve the right to amend these Terms at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended. We therefore recommend that each time you access our website you read these terms and conditions.

OUR SERVICES

All prices are in New Zealand Dollars (NZD) and are inclusive of GST. We endeavor to ensure that our price list is current. Our price list can be accessed from our home page and we reserve the right to amend our prices at any time. If you have made a booking, we reserve the right to cancel your booking should our prices change.

Payments and expenses

Deposit: All bookings require a 30% deposit to confirm your booking. This deposit is fully refundable:

  • For weddings up to and including the date 12 weeks prior to your booking date; or
  • For all other general beauty bookings (i.e. makeup and hair, beauty therapy and spartie bookings) up to and including the date 21 days prior to your booking date.

If your wedding booking is made within 12 weeks of your booking date, the deposit will not be refundable. If you general booking is made within 21 days of your booking date, your deposit will not be refundable.

Full payment: The payment of the remainder of your balance of your booking is due 7 working days prior to the booking date, unless agreed otherwise with b.o.d. If full payment is not received by the due date, we reserve the right to cancel your booking and retain the deposit.

Add-ons: Additional services or add-ons on the day are acceptable if your therapist agrees. Payment in full for any additional services agreed with your therapist must be made at the time of your treatment.

Parking and travelling fees: Depending on the location of your booking additional travel costs may apply. These may include for example mileage, petrol, flights, travel or stand-down time, ferries. We will do our best to quote you travel costs at the time of booking, however in the unlikely event that additional reasonable travel expenses are incurred you agree to refund b.o.d on demand.

Parking fees are an added cost payable by you. If your booking is in a hotel, we quote parking accordingly prior to your booking date. Your therapist may charge the parking to your room unless other prior arrangements are made. If parking is not provided and metered parking is available, someone in your group needs to be responsible to feed the meter while your therapist is working. Any parking tickets issued to your therapist whilst attending your booking are your responsibility to pay. You agree to pay any parking tickets issued on demand.

Your booking

Confirmation of booking: Once your deposit has been received, you will receive a confirmation receipt from b.o.d and we will assign a therapist to you booking.

b.o.d squad Therapists: When booking please let us know if you have a preferred therapist and we will do our best to accommodate your request. The same therapist booked for your trial will be booked for your wedding. In the unlikely event she/he has become unavailable we will send another therapist. Our therapists take detailed notes at trials for in the unlikely event that they are sick or unexpectedly unable to make your wedding or booking date.

Trial: A trial includes one hair style and one makeup application. Additional hair styles or makeup applications may incur additional fees payable to your therapist on the day. If you would like to have another trial because you have decided you want a different look please be prepared to pay the amount stated. Trials are non-refundable upon completion.

Time Management: Upon booking we will send you a run-sheet for the day. Please try and stick to this in order for us to complete your services correctly and on time. We are not responsible if your desired completion time is not met due to delays caused by you or your party. It is your responsibility to get in touch if there are timing changes. Note that we may have more than one wedding to attend and times changes up to a week prior to your wedding may not be possible.

Refunds and cancellation

Cancellation: Cancellations may be made via email to info@beautyondemand.co.nz. Cancellation is confirmed once b.o.d has acknowledged your cancellation and replied in writing. Wedding cancellations made within 20 weeks of the booking date and general beauty cancellations made within 21 days of the booking date will result in your deposit being forfeited. No-shows, cancellations booked and paid withen 7 days of full payment made, or treatment deductions not notified to b.o.d in advance are subject to a 100% cancellation fee.

Quality assurance

The b.o.d squad work to the highest standards and will do their best quality of work for you and your guests. Please let your b.o.d therapist know if you have any concerns with any products or skin sensitivities.

 

OUR PRODUCTS

Our products are for sale to adults over the age of eighteen (18) years. By proceeding to purchase through our website, you acknowledge that you are over 18 years of age. We strive to ensure that our products are described as accurately as possible on our website, however we do not warrant that the description is accurate.

The images of the Products on our site are for illustrative purposes only. Your Products may vary slightly from those images. Packaging of the Products may vary from that shown on images on our site.

Prices: We try our best to ensure that our product list is current however we give no undertaking as to the availability of any product advertised on our website. All prices are in New Zealand Dollars (NZD) and are inclusive of GST. We reserve the right to amend our prices at any time. Packaging and postage is an additional charge, calculated and advised at time of purchase.

Ordering: When you order from us, we require you to provide your name, address for delivery, your email address, telephone contact and credit card details. We will take care with this information; however in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.

Delivery: Delivery of your ordered product/s will be as set out on our website. Title in the goods passes to you when we have received payment. Our terms of payment are set out on the order page. All risk of loss or damage to the goods passes to you when we dispatch the goods.

Refunds: We undertake to reimburse you for any product delivered to you that is faulty or is in a damaged condition. If you wish to return a faulty or damaged product, you must notify us by emailing info@beautyondemand.co.nz. If we are unable at the time of return to replace or exchange returned goods, we will reimburse for the purchase including packaging and postage charges.

GENERAL TERMS

Disclaimers: Whilst we have taken all due care in providing the information on our website, we do not provide any warranty either express or implied including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose. To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded.

Limitation of Liability: Except for any liability that cannot be excluded by law, b.o.d (including its officers, employees and agents) excludes all liability (including for negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of our services or products, including, but not limited to, where arising out of the following: (a) any allergic or other reactions to products or products use; (b) any damage to property; (c) participation in a booking the promotion or use of a product.

Indemnity: By accessing our website, booking our services or buying our products, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website, services and products.

Privacy: We collect personal information in order to provide our products and services and may, for this purpose, disclose such information to third parties, including, but not limited to, suppliers and therapists. You agree that we may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning you. You should direct any request to access, update or correct information to b.o.d.

Governing law: These Terms and Conditions are governed by the laws of New Zealand.
